INTRODUCTION

You agree to use Miahy.com website (the “Website”) owned & operated by Melhor General Trading LLC. , only for purposes that are permitted by this Terms & Conditions and any applicable law, regulation or generally accepted practices or guidelines in the relevant jurisdictions.

You agree that you will not access or attempt to access the Website other than through the interface that is provided by Miahy.com, unless you have specifically been permitted to do so in a separate written agreement signed by an authorized representative of Miahy.com.

You specifically agree not to access or attempt to access the Website, or any portion thereof, through any automated means, including but not limited to the use of scripts or web crawlers. You agree that you will not engage in any activity that disrupts or otherwise interferes with the Website (or the servers and networks which are connected to the Website). You agree that you will not duplicate, reproduce, copy, sell, trade or resell the Website for any purpose.

You agree that you are solely responsible for any breach of your obligations under this Terms & Conditions and for the consequences (including any loss or damage which Miahy.com may suffer) of any such breach.

YOUR ACCOUNT AND AMENDMENT TO THE TERMS OF USE

You may be required to register with Miahy.com in order to access certain services or areas of the Site. With respect to any such registration, we may refuse to grant to you the user name you request. Your user name and password are for your personal use only. If you use the Site, you are responsible for maintaining the confidentiality of your account and password and for restricting access to your computer, and you agree to accept responsibility for all activities that occur under your account or password. In addition to all other rights available to Miahy including those set forth in these Terms & Conditions, Miahy reserves the right, in its sole discretion, to terminate your account, refuse service to you, or cancel orders.

We may from time to time modify or change the Terms and Conditions. The revised Terms of Use will govern your future use of our Site and Service, so we strongly suggest that you visit and review our Terms of Use periodically. Each version is specifically dated. If you do not agree to the revised version, you must immediately stop using our Site and Service. Our Terms of Use were last updated on 28 April 2018, Terms and Conditions Agreement applies from this date onwards.

INTELLECTUAL PROPERTY

These Terms and Conditions apply to Miahy, henceforth known as “Miahy.com”

All content included on the Site, such as text, graphics, logos, images, audio clips, video, data, music, software, and other material (collectively “Content”) is owned or licensed property of Miahy.com or its suppliers or licensors and is protected by copyright, trademark, patent, or other proprietary rights. The collection, arrangement, and assembly of all content on the Site is the exclusive property of Miahy.com. Miahy.com and its suppliers and licensors expressly reserve all intellectual property rights on all Content.

LEGAL CAPACITY TO MAKE AGREEMENTS AND TRANSACT

If you are under eighteen (18) years of age, you cannot place orders with Miahy.com. By accepting these Terms of Use you acknowledge that you are over the age of eighteen (18) years. Should Miahy.com suffer any damage or other losses as a result of a transaction entered into by a minor, Miahy.com reserves the right to seek compensation for such losses from the parents or guardians of the minor who caused any order(s) to be placed with Miahy.com

PRODUCT SUITABILITY

Please note that the products on the main Miahy website are designed for

1. Home use only
2. Semi-commercial
3. Commercial

Home use only products carry a home use warranty alone. Equipment purchased from our website and used in a non-domestic environment will render the warranty null and void unless the equipment description states it is suitable for commercial use.

In case of semi-commercial product/equipment, the warranty will be available under both instances- for home use as well as commercial use.

PRICING

Miahy.com ‘Normal Price’ is usually the Manufacturer’s or Supplier’s Recommended Retail Price and may include carriage where applicable. On imported and ‘Own Branded’ products, our ‘Normal Price’ is based on equivalent products in the market and can be quantified on request.

VAT

All products listed on our retail shop are priced inclusive of VAT which is 5 percent of product value after discounts, if discounts are applicable.

PRICE MATCH

Although we are confident that our prices are competitive, if you find the same product elsewhere we will price match it.

Alternative supplier products must be brand new and must be ‘like for like’ with regards to specification and colour and carry a comparable guarantee and be in stock at the time of purchase for powerhouse to price match.

FREE DELIVERY

Free Delivery is applicable on all products above 100 AED across UAE.

Free installation is applicable on all equipment for assembling the same. No instances that involves drilling or boring for the purpose of fixing the equipment come under this.

PAYMENT

Miahy.com currently offers

1. a) COD (“Cash on Delivery”)
2. c) Debit and Credit card payments

Payment & Delivery options are applicable within United Arab Emirates only.

DATA PROTECTION

All customer information will be treated under the terms of the Data Protection Act. We shall use it under certain instances (For more information, visit our Privacy Policy Page). We may identify and inform you of other products and services offered by Miahy.com which would be of interest to you. You must tell us if you do not wish us to do so.

We do not store credit card details nor do we share customer details with any third parties.

COMPLAINTS

Miahy.com take all of our customers seriously and we try to offer them the best possible service available, however if you feel you have something to complain about please contact us.

CUSTOMER SERVICE

All prices quoted are correct at time of going to press, due to circumstances beyond our control these may change, including rate of Value Added Tax. The price levied will be confirmed at the time of ordering.

Incorrect/Faulty goods must be returned to us before replacements will be dispatched.

We strive to keep the majority of the products listed on our website in stock at all times. Occasionally some items are out of stock. If you order an item that is out of stock, we will contact you within 48 hours (2 working days) and advise you when the item is due back in or of any comparable product that is available.

Refunds will be made in the original payment method and within 14 days of our receipt of goods. All refunds must be authorized by our staff.

YOUR RIGHT TO CANCEL

Free 5 days Return If you are not 100% satisfied with your purchase, you can return it for free and get a full refund. Just make sure to contact us within 3 business days from the day your order is delivered, and ensure that the item is in its original packaging, unworn and in the same condition you received it. If the item you have received is damaged, defective or not as described on the website, you will receive a full refund along with any shipping fees incurred.

Once received the returned order, the refund payment will be processed in 7-14 working days

Returns: Fitness & Sports Equipment

All Fitness & Sports Equipment’s are not refundable once installed, if any mechanical defect on the equipment’s, the product shall be replaced or repaired free of charge.

Please note: our couriers do not collect any unpackaged goods.

All order cancellations or returns must be notified to us by e-mail only. If you wish to cancel or return goods please e-mail our Customer Service Department at the address, please email [email protected]

No cancellation of order will be accepted after 14 days from delivery of goods.

Goods that we don’t normally stock, are not part of our core product line or are specially specified by customers are classed as ‘made to consumer specification’ and therefore are not covered by distance selling regulations.

DISCLAIMER

Miahy.com endeavour to keep product information as up to date as possible. However, specifications are liable to change without notice. Product photographs are intended to illustrate the particular model but may, occasionally, not reflect the product as sold. Unless specifically stated, weights, bars and other accessories shown on photographs are not included – please call for further details on any particular product.

While every effort is made to provide accurate and up to date information, Miahy.com cannot be held responsible for any errors or omission on our website or brochures.

Although Miahy.com make all efforts to ensure that all pricing information on the website is accurate, occasionally an error may occur and goods may be mispriced. If a pricing error is discovered or an order is placed at the erroneous price we will, at our discretion, either: contact you and ask you whether you wish to cancel your order or continue with the order at the correct price; or notify you that we have cancelled your order. We will not be obliged to supply goods at the incorrect price.

All orders made by you through the Website are subject to acceptance by us. We may choose not to accept your order for any reason and providing no payment has been taken nor any explicit acceptance of your order has been accepted, we will not be liable to you or to anyone else in those circumstances.

After submitting an order to us we will send you an order acknowledgement email with your order number and details of the goods that you have ordered. Please note this email is an acknowledgement and is not an acceptance of your order.

For certain goods, information concerning stock availability is not available on the Website. If you order goods which are not available from stock, we will contact you by e-mail and you will have the option to wait until the goods are available from stock, or cancel your order in accordance with our cancellation and returns policy. In the event your order is cancelled, we will refund any payment already collected from you in respect of that order, in accordance with our cancellation and returns policy.

Any email or other electronic acknowledgement by us regarding receipt of an order placed by you does not constitute legal acceptance by us of your order.

While every care has been taken to ensure that this website is virus-free, Miahy.com accepts no liability for viruses or virus damage as result of using this website.

Nothing in these terms and conditions affect your statutory rights.

In order to protect the website visitors to the best of our knowledge, we implement several security policies and certificates. These layers of protection could be by-passed if the user’s computer is/was infected with a virus or malicious software. Miahy.com or its associated partners and employees cannot be held responsible in such a scenario or circumstance.

Miahy.com reserves the right to refuse a delivery or honour an order from a Customer who has not paid part or the totality of a previous order or with whom a litigious dispute is in progress. Miahy.com also reserves the right to take any necessary steps including legal action in case of outstanding or non-payment of fees by you.

LIMITATIONS OF LIABILITY

IN ALL CIRCUMSTANCES MIAHY.COM ‘S MAXIMUM LIABILITY IS LIMITED TO THE PURCHASE PRICE OF THE PRODUCTS SOLD. MIAHY.COM SHALL NOT, UNDER ANY CIRCUMSTANCES, BE LIABLE UPON A CLAIM OR ACTION IN CONTRACT, TORT, INDEMNITY OR CONTRIBUTION, OR OTHER CLAIMS RELATING TO THE PRODUCTS IT SELLS WHICH EXCEEDS THIS LIABILITY LIMIT. MIAHY.COM SHALL NOT BE LIABLE FOR THIRD PARTY CLAIMS FOR DAMAGES AGAINST THE CUSTOMER, OR FOR MALFUNCTION, DELAYS, INTERRUPTION OF SERVICE, LOSS OF BUSINESS, LOSS OR DAMAGE TO EXEMPLARY DAMAGES, WHETHER OR NOT MIAHY.COM HAS BEEN MADE AWARE OF THE POSSIBILITY OF SUCH CLAIMS OR DAMAGES.

If you are dissatisfied with the Site or any content or materials on it, your sole exclusive remedy is to discontinue your use of it. Further, you agree that any unauthorized use of the Site and its services as a result of your negligent act or omission would result in irreparable injury to MIAHY.COM and MIAHY.COM shall treat any such unauthorized use as subject to the Terms and Conditions of this User Agreement.

GOVERNING LAW

This User Agreement is governed by, and construed in accordance with, UAE law. This clause will survive any expiry or cancellation of this User Agreement for any reason.
